Brubaker & Associates, Inc. (BAI) is a leading advisor in the ever-changing regulated and competitive energy markets. Because we do not own or market a commodity, and do not have financial arrangements with those who do, we are able to provide objective advice for our clients. Many of our professionals have been in practice for more than 25 years. Our clientele consists of industrial, commercial and institutional users of electricity, natural gas, coal, fuel oil, steam, water and wastewater services.

We provide consulting services on all aspects of the ratemaking process.  This consists of rate case, litigation and legislative support. Our professionals have participated on behalf of clients in thousands of utility regulatory and legal proceedings in the United States and Canada.

We provide energy procurement and management services in the areas of regulated and competitive supply management. We have assisted clients in managing energy costs on an ongoing basis, consistent with corporate guidelines.

Most sectors of the utility industry are regulated at either the state or federal levels. In addition to the regulatory roles ensuring reliable utility service, in most instances, these regulatory agencies also regulate the utility rates that customers pay. In states that do not offer competition for electricity generation supply, for example, the state's public service commission regulates the prices utilities may charge for electricity commodity itself (generation) for "transmission" of power from the generating stations to the local distribution systems and for "distribution" of the power to the ultimate consumers. In those cases, the entire menu of services from one supplier is referred to as "bundled" service. In states that allow for competition in the generation portion of electric service, the state regulates only the prices only for distribution delivery service.

The Federal Energy Regulatory Commission has jurisdiction over the rates for generation and transmission service at the wholesale market level.

Regulation of these services and rates is a complex process that normally is accomplished in the context of legal proceedings where utilities, regulator staff members, and other interested parties are allowed to present evidence to the regulator related to the overall cost of the utility service, and the specific rates that should be paid by any particular set of customers.

The laws establishing the regulatory process at the federal and state levels are, of course, set under a legislative process, where legislators hear the positions of various interest groups on the potential impacts of laws on customers in on the utilities. Finally, even with the legislative process and the regulatory process available at the state and federal levels, there sometimes is the need for litigation to seek to ensure that laws are properly followed and utility or supplier contracts are properly honored.

At BAI, we assist our clientele in all of the above phases through regulatory and litigation support as part of our energy and economic consultation activities. We work closely with our clients and applicable legal counsel to develop effective strategies and to present persuasive expert testimony before state and federal regulators, legislative bodies and civil courts.

BAI strives for "win-win" resolutions for clients. However, some matters cannot be resolved without litigation. BAI professionals apply their knowledge and experience to support litigation, including discovery, depositions, trial preparation, analysis and expert testimony.
